Terms and Conditions for Purchase

Acceptance: Surge Fit LLC and its contractors and agents provide their services to you subject to these Terms and Conditions and when you purchase the training you accept these Terms and Conditions. Please read these Terms and Conditions carefully before booking the training.

Instructor Training: In these Terms and Conditions, “Instructor Training” means the training for the specific Surge Fit or Surge Strength program.

Warranty: You warrant that you are purchasing the Instructor Training for the purpose of conducting Surge Fit or Surge Strength classes in accordance with the Instructor Agreement.

Initial Training: By accepting these Terms and Conditions you are indicating that you wish us to provide you the Surge instructor training based on the information as set out on the Surge Fit website.

Certification: You agree that in order for you to be considered for certification, you must first.

Complete all of the Instructor Training
Have a Surge instructor account and subscription
Submit a video of yourself conducing a Surge class within 90 days of the Instructor Training.

Surge Fit will certify you when you have satisfied the video assessment guidelines as outlined in the Instructor Training and Instructor Portal.

Pricing and Payment: You must pay the Price for the Instructor Training as set out on our website, together with any relevant sales tax. Surge Fit reserves the right to change prices on the site. The price for the Instructor Training includes the services of Surge Fit approved trainers, provision of venue at which the Instructor Training is held (for in-person trainings) and provision of all relevant course material for the Instructor Training, but does not include meals, accommodations for attendees or apparel. Payment must be made through our website www.surge-fit.com.

Incorrect Pricing and Information: In offering information, products or services including the Instructor Training on the Surge Fit website, Surge Fit attempts to be as accurate as possible. However, Surge Fit does not warrant that information, products and service descriptions or pricing is accurate, complete or error-free. In the event that Surge Fit determines that the Instructor Training is mis-priced, taxes and duties are incorrectly calculated, or the Instructor Training contains an inaccurate description, Surge Fit will notify you of the error before the Instructor Training is provided and you will have an opportunity to cancel or amend your request for Instructor Training within a specified time.

Cancellations, changes, or alterations by Surge Fit for In-person or Live Virtual Trainings: Surge Fit will endeavor to hold the Instructor Training on the scheduled date but reserves the right to cancel or postpone any Instructor Training. In the event that Surge Fit determines it is necessary to cancel or postpone an Instructor Training, Surge Fit will notify you of such cancellation or postponement as soon as practicable and will give you an opportunity to cancel (with a full refund of the payment you have made in respect of the Instructor Training) or rebook an alternate Instructor Training. Surge Fit is not otherwise liable for compensation in respect of any travel, accommodation or other expenses you have incurred in reliance on the Instructor Training proceeding on the scheduled date.

On-Demand Trainings: There will be no refunds given for the purchase of the On-Demand Surge Fit or Surge Strength Instructor Trainings.

Cancellations, changes, or alterations by you for In-person or Live Virtual Trainings: Following confirmation of a purchase of Instructor Training, purchases of Instructor Training can only be cancelled, changed or otherwise altered prior to 10 days before the scheduled date of the Instructor Training purchased. If you cancel prior to this date, Surge Fit will refund you payments in respect of the Instructor Training, less an administration fee of $50 for the Instructor Training purchased. No refund will be made or compensation paid in respect of cancellations, changes or other alterations made after 10 days before the scheduled date of the Instructor Training. If you fail to cancel your ticket prior to the start time of the training, you will be considered a no-show and no refund will be given. To cancel or alter your purchase of Instructor Training, send a written notice by email to Surge Fit at info@surge-fit.com.

Warranties and Liability: Surge Fit warrants that it will endeavor to provide the Instructor Training on the specified date. To the fullest extent possible Surge Fit otherwise disclaims all warranties, express or implied including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Surge Fit shall not be liable for any loss or damage of any kind whatsoever, arising from the supply of training to you, including consequential loss whether suffered or incurred by you or another person and whether in contract or in tort (including negligence) or otherwise and irrespective of whether such loss or damage arises directly from a breach of these terms and conditions by Surge Fit. In no event will Surge Fit be liable for any amounts greater than the amount you have paid for the Instructor Training ordered. Any claim brought by you in connection with the Instructor Training must be brought within 1 year of the date of purchase of the relevant Instructor Training is confirmed.

Nutrition Programs: We do not offer refunds for Nutrition Programs

Waiver: Failure by Surge Fit to enforce any of these Terms and Conditions shall not be deemed to be a waiver of any of the rights or obligations Surge Fit has under these Terms and Conditions.

Entire Agreement: These Terms and Conditions, together with the Instructor Agreement referred to above, contain all the terms, representations, and warranties made between the parties and supersede all prior discussions and agreements covering the subject matter of these Terms and Conditions.
